These Terms of Service (“Terms”) govern your access to and use of EmailTemplateEngine (“the Service”), operated by theboomer.dev (“we,” “us,” or “our”). By using the Service, you agree to be bound by these Terms.

1. Service Description

EmailTemplateEngine is an API-first email template rendering platform. The Service allows you to create, version, store, and render email templates via REST API and MCP Server. The Service does not send emails, manage mailing lists, or provide email delivery infrastructure. You are responsible for integrating rendered templates with your email service provider of choice.

2. Account Registration

To access the Service, you must create an account through our authentication provider (Clerk). You agree to provide accurate and complete information during registration. You are solely responsible for:

Maintaining the confidentiality of your API keys and credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or exhibit suspicious activity.

3. API Usage & Fair Use

Usage limits vary by subscription tier as described on our Pricing page. Fair use provisions apply:

Automated scraping, reverse engineering, or abuse of the API is prohibited
Resale of the Service as a standalone product without written permission is prohibited
Rate limits are enforced per API key; circumventing rate limits is prohibited

We may adjust rate limits and fair use thresholds with reasonable notice to maintain service quality for all users.

4. Data Ownership & Privacy

You retain all ownership rights to the template content, variables, and data you store in the Service. We claim no intellectual property rights over your content. We do not train AI models on your templates or data. Data handling practices are detailed in our Privacy Policy.

5. AI Generation Features

The Service may offer AI-powered template generation via third-party providers (OpenRouter, which routes to models such as Gemini, GPT, Claude, and DeepSeek). When you use AI generation, the content of your prompt is sent to the selected provider for processing. We do not store prompts beyond what is necessary to deliver the generated template. You are responsible for reviewing AI-generated content before use in production.

AI-generated templates may contain errors, inaccuracies, or inappropriate content
Do not submit sensitive personal data through AI generation prompts
AI outputs are non-deterministic and may vary between requests

6. Service Level & Availability

We aim for 99.9% uptime for the API and rendering endpoints. However, we do not guarantee uninterrupted availability. The Service is provided “as is” without warranties of merchantability or fitness for a particular purpose. Planned maintenance will be communicated via the status page. We are not liable for damages arising from service interruptions, data loss, or API changes.

7. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or data loss.

8. Termination

You may terminate your account at any time through the dashboard. Upon termination, your templates and data will be deleted within 30 days. We may terminate or suspend your account for violation of these Terms, with or without notice.

9. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Madrid, Spain.
